Activities of the Legal Advisor
The Legal Advisor has been actively involved in a variety of issues concerning the NSC daily work, the majority of which are classified. Following is a short review of the Legal Advisor's main overt activities:
The Legal Framework of the National Security Council
Article 7 of the Government Act and a government resolution from 1999 serve as the legal framework for the NSC, Following bills that were brought to the Knesset it was decided to base the status of the NSC in legislation. This would be done according to the recommendation of the special committee, established to implement the Vinograd recommendations, headed by Amnon Lipkin Shahak.
The New Anti Terrorism Act
As part of an interagency team, the legal advisor and his stuff are involved in drafting a new law that will provide the competent authorities modern tools to cope with terror acts.
Legal Aspects of Financing Terror
In accordance with government resolution the legal advisor office is taking an active part in leading the legal activity against terror financing.
Israel's Immigration policy its implications on the Citizenship Law and entry into Israel
During 2004 – 2005, as part of the NSC's work related to the issue of immigration to Israel and its impact on the Citizenship Law a, numerous issues arising from the unique character of Israel were examined. Among these – the State's character, the composition of its population, and how these factors impact one on another. The recommendations were presented to the Government on the 4th of April 2005, and were unanimously adopted.
Allocation of Personnel from the Army to the Police Forces
Activity objective:
The work centered on examining the possibilities of reinforcing personnel from the army to the police. In addition, the NSC dealt with the moral – public – legal questions raised by mandatory recruitment to the police. The NSC's position was that 18 year olds should not be viewed only as a national resource for the IDF, and that there is no reason to prevent the allocation of a fixed number of soldiers to the police forces to perform police work.
The NSC's recommendations were presented to the Government and were approved in January 2006.
